These terms cover joeystoydrive.org, the partner portal, the Joey’s Toy Drive iPhone app, and text messages we send. By using any of them you agree to these terms and to our Privacy Policy. If you do not agree, please do not use them. When a form or sign-up screen asks you to check a box agreeing to these terms, checking it is your agreement. We record when you agreed and which version you saw.
Who We Are
Joey's Toy Drive is a nonprofit based in San Jose, California, that collects new, unwrapped toys and distributes them as Christmas gifts to children in need throughout the San Francisco Bay Area. Accounts
Portal and app accounts are for adults running or helping with a drive. Keep your password private, give us accurate contact details, and tell us if you think someone else has used your account. You are responsible for what happens under it. We may close an account that is used to mislead partners, families, or us.
Donations
A toy you donate is a gift to Joey’s Toy Drive, and we distribute it at our discretion to children in need through partner organizations. Toys should be new and unwrapped. We check them against Consumer Product Safety Commission recalls and may set aside anything that is used, recalled, or unsafe. Monetary gifts support the program. Once processed, they are not refundable unless made in error. We will tell you plainly on the donation page what tax treatment, if any, applies.
Hosting a Drive
If you host a collection drive, you agree to keep the collection box in a safe, visible spot, to hand over everything you collect, and to use our name and logo only on materials we provide or approve. You may say publicly that you are a Joey’s Toy Drive collection partner, but please do not imply that we endorse your business or its products.
Volunteering
You must be 18 or older to volunteer. You work under the volunteer agreement you sign at onboarding, which governs shifts, safety rules, age limits, and driving. To drive, you need approval from our Executive Director, and you must be 21 or older with a valid driver’s license and current insurance. If these terms and a volunteer document you signed differ, the signed document controls.
Text Messages
If you check the box on one of our forms or in the app, you agree to receive text messages from Joey’s Toy Drive about volunteer shifts, toy pickups and deliveries, and event updates. We do not send marketing texts. Consent is not a condition of volunteering, donating, or hosting a drive. Message frequency varies, up to 8 messages per month. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Reply STOP to any message to cancel at any time; you will receive one final confirmation message. Reply HELP for help, or contact us at the email or phone number above. Mobile numbers and opt-in consent are never shared with or sold to third parties for marketing.
Our staff can also enroll in the Staff Assistant, an automated service that answers questions about our operations by text. Staff whose numbers our Executive Director has authorized enroll by texting JOIN to (669) 267-7778 and replying Y. It answers the questions staff text it and sends enrolled staff questions about delivery planning. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Reply STOP to cancel at any time, or HELP for help.
Our Content
The Joey’s Toy Drive name, logo, photos, and site text belong to us or are used with permission. Partners may use the materials we provide for their drive. Anything else needs our written okay. We use photos of volunteers and events only with the consent we collect at onboarding.
What We Cannot Promise
We provide the site, portal, and app as they are. We work to keep them accurate and available, but we cannot guarantee either. We are not liable for losses that come from relying on them or from an outage. Nothing here limits liability that California law does not allow us to limit.
Changes and Law
When something material changes, we update this page and the date at the top. If you keep using the site, portal, app, or our text messages after a change, you accept it. California law governs these terms, and any dispute belongs in the state or federal courts in Santa Clara County.
