These terms cover joeystoydrive.org, the partner portal, the Joey’s Toy Drive iPhone app, and text messages we send. By using any of them you agree to these terms and to our Privacy Policy. If you do not agree, please do not use them.
Who we are
Joey's Toy Drive is a nonprofit based in San Jose, California, that collects new, unwrapped toys and distributes them as Christmas gifts to children in need throughout the San Francisco Bay Area. Accounts
Portal and app accounts are for adults running or helping with a drive. Keep your password private, give us accurate contact details, and tell us if you think someone else has used your account. You are responsible for what happens under it. We may close an account that is used to mislead partners, families, or us.
Donations
Toy donations are gifts to Joey’s Toy Drive and are distributed at our discretion to children in need through partner organizations. Toys should be new and unwrapped; we screen against Consumer Product Safety Commission recalls and may set aside anything that is used, recalled, or unsafe. Monetary gifts support the program and are not refundable once processed unless made in error. We will tell you plainly on the donation page what tax treatment, if any, applies.
Hosting a drive
If you host a collection drive you agree to keep the collection box in a safe, visible spot, to hand over everything collected, and to use our name and logo only on materials we provide or approve. You may say publicly that you are a Joey’s Toy Drive collection partner. Please do not imply that we endorse your business or its products.
Volunteering
Volunteers work under the volunteer agreement they sign at onboarding, which governs shifts, safety rules, age limits, and driving. Where these terms and a signed volunteer document differ, the signed document controls.
Text messages
If you check the box on one of our forms or in the app, you agree to receive text messages from Joey’s Toy Drive about volunteer shifts, toy pickups and deliveries, and event updates. We do not send marketing texts. Consent is not a condition of volunteering, donating, or hosting a drive. Message frequency varies, up to 8 messages per month during the December toy drive season. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Reply STOP to any message to cancel at any time; you will receive one final confirmation message. Reply HELP for help, or contact us at the email or phone number above. Mobile numbers and opt-in consent are never shared with or sold to third parties for marketing.
Our content
The Joey’s Toy Drive name, logo, photos, and site text belong to us or are used with permission. Partners may use the materials we provide for their drive. Anything else needs our written okay. Photos of volunteers and events are used only with the consent we collect at onboarding.
What we cannot promise
The site, portal, and app are provided as they are. We work to keep them accurate and available but cannot guarantee either, and we are not liable for losses that come from relying on them or from an outage. Nothing here limits liability that California law does not allow us to limit.
Changes and law
We update this page when something material changes and mark the date at the top. Continued use after a change means you accept it. These terms are governed by California law, and any dispute belongs in the state or federal courts in Santa Clara County.
